Terms and Conditions

These Terms govern your access to the AVnester website, mobile apps, the public MCP server at mcp.avnester.com, and the ChatGPT Actions integration (together, the "Platform"), operated by AVNESTER PRIVATE LIMITED, a private limited company incorporated in India, with registered office at 16/160 Giri Nagar, 1st Street, Kavundampalayam, Coimbatore - 641030, Tamil Nadu, India.

By using the Platform you agree to these Terms, our Privacy Policy at /privacy, and — where applicable — our AI / MCP Acceptable Use Policy at /legal/ai-use. If you do not agree, do not use the Platform.

AVnester is an online listings platform that helps users discover residential properties in India, send inquiries to listing owners and agents, and use related tools (search, locality insights, EMI and stamp-duty estimators).

AVnester acts as an intermediary under the Information Technology Act, 2000 §79. We do not own, sell, broker, lease, or guarantee any property. We are not a party to any transaction between users.

AVnester is not itself a "real estate agent" under the Real Estate (Regulation and Development) Act, 2016. Agents and builders publishing listings on the Platform are independently responsible for their own RERA registrations and disclosures.

AVnester does not provide financial, legal, tax, or investment advice. Calculators on the Platform return regulatory-rate estimates for informational purposes only.

You must be at least 18 years old and competent to contract under the Indian Contract Act, 1872. If you act for an organisation, you confirm you are authorised to bind it.

You agree to give accurate information at registration and keep it current. You are responsible for the security of your credentials and for activity under your account; tell us immediately at security@avnester.com if you suspect unauthorised access.

One account per person or entity unless we agree otherwise in writing. We may suspend or terminate accounts that we reasonably believe violate these Terms.

You must not: break applicable law; scrape, crawl, or use automation against the Platform without written permission; impersonate others or misrepresent affiliation; upload harmful, obscene, defamatory, or unlawful content; attempt to access systems or accounts you are not authorised to use; distribute spam or malware; or resell, sublicense, or re-publish Platform data in a way that competes with or undermines the service.

Sellers and agents must not embed prompt-injection content (instructions to LLMs, hidden tokens, role-confusion phrases) in listing titles, descriptions, or other user-visible fields. Bypass attempts result in listing removal and account suspension.

Use of the Platform via AI clients (Claude, ChatGPT, others) is additionally governed by /legal/ai-use.

You confirm that you have the rights and consents needed to publish your listings and content, and that the information you provide (price, area, location, images, RERA number where required) is accurate to the best of your knowledge.

Where RERA applies to your listing or project, you must hold all required registrations and make all required disclosures on the listing itself.

AVnester does not verify ownership, title, encumbrances, or accuracy of listings. Any "verified" or similar tag means only what we explicitly describe (e.g., a document check) and is not a guarantee of title, area, price, or legal status. Buyers, tenants, and agents must conduct independent due diligence before transacting.

We may decline, remove, or restrict any content that we reasonably believe breaches these Terms, applicable law, or our policies. We make no guarantee about ranking, ordering, or duration of display.

You grant AVnester a non-exclusive, royalty-free, worldwide licence to host, display, and distribute your content for the purpose of operating and promoting the Platform.

When you send an inquiry, your name, contact details, and message are shared with the listing owner or agent so they can respond. Use of inquirer contact details is limited to that property inquiry and to compliance with applicable data-protection law.

Credits may be required to take certain actions (e.g., to contact listing owners). Credits are consumed under the rules in effect at the time. We do not guarantee any response, conversion, or outcome from a credit spend.

Fees for paid features (credits, listing boosts, subscriptions) are displayed at the point of purchase in Indian Rupees, exclusive of applicable taxes, and are payable via Razorpay or another listed processor.

Refunds: failed transactions are reversed automatically through the payment processor. Other refund requests are considered case-by-case in line with the Consumer Protection Act, 2019, and must be raised within 14 days of the charge by emailing info@avnester.com.

Nothing in these Terms limits your statutory rights as a consumer.

The Platform, its software, branding, and original content (other than user content) are owned by or licensed to AVnester. You may not copy, modify, or distribute them without our written consent.

We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Platform for your personal or internal business purposes in line with these Terms.

Our handling of personal data is described in the Privacy Policy at /privacy.

Voice assistant (Ava): voice features are optional and require your microphone permission. By speaking to the assistant you consent to your audio being transcribed by our speech providers. See the Privacy Policy for details.

Voice call recording: when you place a voice call with Ava, we record the call — both your spoken audio and Ava's replies — and keep it for up to 90 days to review quality, investigate issues, and improve the assistant. Recordings are accessible only to authorised AVnester staff over secure, audit-logged access; they are never made public and are not used to train models without your separate consent. You can turn recording off at any time in Settings → Privacy ("Voice call recording"); turning it off stops future recording and deletes the call audio we have stored for you. You can keep using Ava by text or voice with recording off.

Our public MCP server and ChatGPT Actions are additionally governed by the AI / MCP Acceptable Use Policy at /legal/ai-use, which covers rate limits, attribution, redistribution, prompt-injection rules, and the no-advice disclaimer on calculators.

The Platform is provided "as is" and "as available". To the extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee the accuracy or legality of any listing or user content. AVnester is an intermediary under IT Act §79 and is not a party to any transaction between users.

To the maximum extent permitted by law, AVnester and its officers, employees, and agents are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profit, data, or goodwill.

Our aggregate liability for any claim arising out of or related to the Platform or these Terms is limited to the greater of (a) the amount you paid us in the 12 months before the claim and (b) ten thousand Indian Rupees (INR 10,000).

Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law, including liability for fraud, gross negligence, or death or personal injury caused by negligence.

You will indemnify and hold AVnester harmless from claims, losses, and reasonable legal fees arising from (a) your breach of these Terms; (b) your content; (c) your violation of law or third-party rights; or (d) a dispute between you and another user.

You may stop using the Platform at any time. We may suspend or terminate your access if we reasonably believe you have breached these Terms or if needed to protect the Platform or other users.

Sections that by their nature should survive — privacy, disclaimers, liability, indemnity, governing law — survive termination. After termination, we retain and use data as permitted by the Privacy Policy and applicable law.

We may amend these Terms. The "Last updated" date will move and material changes will be flagged on the Platform. Your continued use after the effective date constitutes acceptance.

These Terms are governed by Indian law. Courts at Coimbatore, Tamil Nadu have exclusive jurisdiction, subject to your statutory consumer rights to approach a Consumer Commission with territorial jurisdiction under the Consumer Protection Act, 2019.
